Tekijäoikeusdirektiivi


Tausta: Tekijänoikeuslainsäädännön uudistus liittyy laajempaan EU:n digitaalisten sisämarkkinoiden kehittämistyöhön.


Tavoite: muutoksen tavoitteena on tuoda sääntely nykyaikaan ja määrittää pelisääntöjä alustojen toimintaan koskien media-alan kustantajia, musiikintekijöitä ja muita sisällöntuottajia.



Vastuu: direktiivi lisää tekijänoikeussuojaa verkossa jaettaville sisällöille siirtämällä vastuun (artikla 13) alustoille; Facebookille, LinkedIn, YouTube, Twitter, XING, Spotify


Uhka: internet/kulttuurin loppu?


Todellisuus; harmaa vyöhyke ; ennakkotapaukset ; käytäntö muovautuu vuosien saatossa.


Mahdollisuus: tuotettuun mediasisältöön tarvitaan lisenssi (artikla 11) mahdollistaa crypto micro payment? maksut.


Start-Upit suojeltu: direktiivin velvoitteet koskevat ennen kaikkea suuria, voittoa tavoittelevia, kaupallisia alustapalveluja, jotka aktiivisesti kuratoivat ja ehdottavat sisältöä käyttäjilleen.  Start up -yritykset huomioitiin kevyemmillä velvoitteilla: direktiivin soveltamisala ottaa huomioon palvelun koon, yleisön määrän ja liiketoiminnan tyypin.
